General Provisions
§ 1. Definitions
- Terms (Terms & Conditions):This document governing the rules of using the justONECARD Website and Application.
- Website / Platform:The website available at justonecard.pl or the justONECARD mobile app (hereinafter referred to as the Application), through which the Service Provider delivers Services.
- Service Provider:JUST ONE Sp. z o.o. based in Poland.
- Electronic Address of Service Provider:contact@justonecard.pl.
- User (You):A natural person with full legal capacity who has entered into a Service Agreement with the Service Provider.
- Account:Individual User profile, a collection of resources and permissions assigned to a specific User, containing provided data and history of activity within the Service/Application.
- Card (justONECARD):The digital counterpart of a loyalty, discount, access or business card managed by the Service/Application, enabling reward collection, points, discounts or Partner identification.
- Partner:An entity (e.g. restaurant, retail store, service provider) cooperating with the Service Provider that publishes Offers to Users via the Platform/Application.
- Offer:A proposal of discount, reward, service or benefit published by a Partner, available for redemption by Users under the conditions determined by that Partner.
- Services:Services provided electronically by the Service Provider to Users, specifically enabling Account management, Card creation and usage, and redemption of Partner Offers.
§ 2. Acceptance of Terms and Privacy Policy
This document constitutes an electronic service agreement concluded between the Service Provider and the User.
USE OF THE APPLICATION OR WEBSITE IS TANTAMOUNT TO ACKNOWLEDGING AND ACCEPTING THESE TERMS AND CONDITIONS AND THE JUST ONE PRIVACY POLICY, WHICH CAN BE FOUND AT justonecard.pl/en/privacy-policy.
If the User does not agree with any of the terms of these Regulations, they may not use the Website or the Application.
Technical Requirements & Scope of Services
§ 3. Technical Requirements
To use the Service/Application, it is necessary to have:
- A terminal device (computer, smartphone, tablet) with Internet access,
- An active email address,
- A device running an up-to-date operating system (e.g. Android, iOS) and an up-to-date web browser.
When using the full functionality of the Services, particularly to collect rewards at Partners, it may be required to enable additional device features (e.g. Bluetooth, Wi-Fi) and geolocation services (see § 6).
§ 4. Scope and Availability of Services
justONECARD is a loyalty platform designed to allow Users to:
- Register and manage Digital Cards,
- Accumulate benefits (e.g. points, stamps) and redeem them for Offers granted by Partners,
- Identify themselves within the Partner network.
The Service Provider does not guarantee that the Website, Application or Services will be available at all times without interruption, and reserves the right to suspend, withdraw or limit availability for technical, business, or operational reasons.
Registration, Account & Card Usage
§ 5. Account Registration and Login
To use the full functionality of the Services, Account Registration is required.
Registration takes place through:
- Completing the registration form in the App/Website (providing email and password), or
- Logging in via third-party services (e.g. Google, Apple, Facebook).
Regardless of registration method, the Service Provider requires: first name, last name, and email address.
The User may optionally provide age and gender if they consent to further personalization of Services and Partner Offers.
The Service Agreement is concluded for an indefinite period upon activation confirmation by the Service Provider.
§ 6. Geolocation Data and Privacy
The Service Provider values privacy. All personal data is processed in accordance with GDPR and the Privacy Policy.
Location: The App utilizes User geolocation data to deliver core Services (e.g. showing nearest Partners, automatic in-store reward collection). Location access is only enabled upon explicit, active consent in device settings.
Sharing Data with Partners: An integral part of the Services is sharing User profile information with Partners for the proper operation of the loyalty system and Offer redemption.
By using the Platform/App, the User consents to disclosing profile information to Partners, including: name, surname, email, age (if provided), gender (if provided), Card status, and history of past service usage with that Partner.
If the User does not wish for their data to be disclosed to Partners in this scope, please refrain from using the Service, Application, or Services.
§ 7. Rules of Usage
The User undertakes to keep login credentials confidential and not disclose them to third parties.
In case of suspected password compromise, the User must inform the Service Provider immediately.
The Service Provider reserves the right to deactivate an Account in case of Terms violations or false information.
Loyalty Services Provision
§ 8. Rewards (Stamps, Points) and Offers
Using the App and completing transactions at Partners allows the User to accumulate Rewards on their justONECARD account according to the rules of the respective Partner.
Accumulated Rewards may be redeemed for Offers (rewards) published by Partners via the App.
Responsibility for Offers: Offers are not offers of the Service Provider (justONECARD). The Partner who authors the Offer bears sole responsibility for its publication, content, and proper fulfillment.
The Service Provider's role is strictly limited to providing the technical and organizational framework for Offer publication and redemption.
If the User believes their Reward balance is incorrect or a Partner failed to honor an Offer, they should contact the Service Provider via email at: contact@justonecard.pl with relevant details and evidence.
§ 9. Functionality and Payments
Basic loyalty service usage (accumulating Rewards, redeeming Offers) is free of charge for Users.
Payments for goods, services or deliveries under Partner Offers are collected directly by Partners or third-party payment providers. The Service Provider is not a party to these transactions.
Electronic payments within the Platform/App are processed by external payment providers whose regulations may apply.
Intellectual Property & Restrictions
§ 10. Proprietary Rights
All proprietary rights (including copyrights, related rights, trademarks) regarding the Website, Application, and Services, and their content (excluding content provided by Partners and Users) remain the exclusive property of the Service Provider.
The User receives a personal, royalty-free, revocable, non-exclusive license to use the Website, App, and Services strictly for purposes permitted by these Terms.
§ 11. Usage Restrictions
The User agrees not to use the Website, App, or Services for any unlawful purpose or prohibited by these Terms.
In particular, it is strictly forbidden to:
- Use the Service for committing fraudulent acts,
- Distribute viruses, malware or other harmful code,
- Attempt to circumvent security measures of the Service/App,
- Use the Platform in a manner that disrupts the operations of the Service Provider or Partners.
Liability & Complaints
§ 12. Warranties & Liability
The User accesses and uses the Application and Services at their own risk.
The Service Provider excludes liability for:
- Damages resulting from improper use of the Service/App,
- Damages caused by denial-of-service attacks, viruses or malware affecting User equipment,
- Content, Offers, and services provided by Partners.
The Service Provider is not liable for lack of service access at any time for technical or network maintenance reasons.
§ 13. Complaints
The User has the right to file a complaint if Services are not provided in accordance with these Terms.
Complaints should be sent via email to: contact@justonecard.pl or in writing to the Service Provider's registered address.
A complaint must include: User details, description of the irregularity with date and time, and the requested resolution.
The Service Provider will process the complaint within 30 days of receipt.
Final Provisions
§ 14. Internet Risks
The User acknowledges that using electronic services carries potential security risks, such as malware, spam, or phishing.
To minimize risks, Users should use antivirus software and keep systems and browsers up to date.
§ 15. Amendments to Terms
The Service Provider reserves the right to amend these Terms for valid reasons (e.g. legal changes, platform feature updates).
Users will be notified of changes via email or in-app announcement at least 14 days before they take effect.
Continued use of Services after changes take effect constitutes acceptance.
§ 16. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Poland.
Any disputes shall be resolved by the competent Polish courts.
